Man fined $14,000 for lack of sex with wife
A Frenchman has been successfully sued by his ex-wife, who claimed he did not have enough sex with her during their 21 years of marriage.
The woman filed for divorce two years ago, blaming his inability to satisfy her sexually for the break up. The 51-year-old man, identified only as “Jean-Louis B.” in press accounts, was then ordered to pay €10,000, or about $14,000 for neglecting his matrimonial duties. Mr B. justified himself by saying health problems and chronic fatigue due to difficult working hours were the cause of his inability to perform, however this did not convince the judge of southern France’s highest court in Aix-en-Provence.
“A sexual relationship between husband and wife is the expression of affection they have for each other, and in this case it was absent,” the judge said. “By getting married, couples agree to sharing their life and this clearly implies they will have sex with each other.”
The ruling is based on “article 215 of France’s civil code, which states married couples must agree to a ‘shared communal life.'”
